Terms of Service

Medabha is in early access. By creating an account, requesting a demo, or using the website, you agree to these terms and to the Privacy policy. If you do not agree, do not use the service.

Early access

Medabha is provided as early-access software. It may contain defects, change without notice, or be unavailable. You must keep independent clinical records and must not treat Medabha as a certified electronic health record, ABDM health locker, or medical device. We may suspend or reset early-access features to protect patients or the platform. Calling the service "early access" describes its stage of development; it does not limit any statutory right you have under Indian consumer or data-protection law, and it does not excuse us from the duties in these terms.

Service

Medabha is clinic operations software and decision-support tooling (including AI drafts, medicine catalogues, and diagrams). It does not practise medicine. You — the registered medical practitioner and clinic — remain solely responsible for diagnosis, treatment, prescriptions, patient consent, and what is written in the signed record.

Your duties under Indian law

You must comply with the NMC / IMC ethics regulations, Telemedicine Practice Guidelines (2020) where you consult remotely, the Drugs and Cosmetics rules for prescriptions, applicable Clinical Establishments rules, and data-protection law. Obtaining informed consent to record a consult, to store health data, and to message a patient on WhatsApp is your responsibility. Medabha is not your Data Fiduciary for patient records; we process that data on your instructions.

If we discontinue the service

We may stop offering the service. If we do, we will email at least 30 days’ notice and, on request, provide the clinic a copy of its records before we delete remaining data. You remain responsible for keeping independent clinical records. If you delete your own account from Settings, deletion is immediate and permanent — export first if you still need the file.

Accounts & billing

Contact us for current fees and included usage. Overage, if any, is agreed with your clinic before it is billed. You must keep login credentials confidential and disable access when staff leave.

Acceptable use

Do not misuse the platform, attempt unauthorised access, or upload unlawful content. WhatsApp messaging must follow Meta policies, patient opt-in, and DPDP purpose limitation — transactional care messages you send are still your clinic’s processing. Do not use AI Scribe to record a patient who has not consented. Keep prescriptions and clinical detail out of broadcast-style messages; Medabha delivers Picture Rx and advice clips as secure per-patient links precisely so raw clinical content is not exposed in a shared template.

Limitation of liability

To the extent permitted by Indian law, Medabha is provided “as is”. We are not liable for clinical outcomes, lost records you failed to export, third-party outages (including WhatsApp, OpenAI, or payments), or indirect damages. Nothing in these terms excludes liability that cannot be excluded for fraud or proven wilful misconduct.
